Kimpton Gift Card Terms and Conditions
By accessing this website and/or using the gift cards issued by KG Gift Card, Inc. ("Kimpton") with card processing and other services provided by Kimpton's service provider, Buyatab Online, Inc. ("Buyatab") (the "Card"), you agree to the following "Terms and Conditions" in addition to any terms and conditions, terms of use and privacy policies on the Kimpton and Buyatab Websites:
NO EXPIRATION DATE OR FEES
The Card has no expiration date or service fees.
PARTICIPATING LOCATIONS, BALANCES AND USE OF CARD
Card issued by Kimpton or as otherwise indicated by Card branding. For Card balances and to review transactions, go to: kimptongiftcard.com. You may use this Card at participating Kimpton hotels and restaurants. We're sorry, but Kimpton Gift Cards are not accepted at this time outside of the America’s as well as at the following locations: Kimpton Aluna Tulum, Parallel 20, Bhanu, Kimpton Hotel Banneker, Le Sel, Lady Bird, Bargello, District 42, Bistro Bis, Zuma, Mums, Osteria Morini, Pacci Italian Kitchen + Bar, Abaca, Dirty Habit, Echo & The Rig, L’Amico, Vine, The Fortunate Fox, Issima, Betts.
CARD USE
You must present the Card at the time of purchase. The purchase amount will be deducted from the available value remaining on this Card. If the value of your purchase exceeds the available value on this Card, you must pay for the remaining balance at the time of purchase. Cards are not refundable and cannot be redeemed for cash in any state, except where required by that state's law.
RELOADING CARDS
You may reload your Card online by visiting kimptongiftcard.com. Card reloads are processed by Buyatab, and any information shared will be subject to Buyatab's Privacy Policy
RELOAD LIMITATIONS AND RULES
The minimum reload amount is $5.00. The maximum amount of funds that can be associated with a single card in any 24 hour period is $2,000 and there is limit of one (1) reload in any twenty-four (24) hour period. Kimpton may change the minimum and maximum reload amounts, the maximum card balance or any other reload features or limits at any time. You are responsible for checking these Terms and Conditions to determine if any changes have been made.
NON-RETURNABLE
Card are not returnable or refundable for cash, except where required by law.
NO LIABILITY; LOST OR STOLEN CARDS
Protect this Card like cash. Neither Kimpton nor Buyatab Online is responsible for lost, stolen, or damaged Cards or unauthorized use. Risk of loss and title for Card passes to purchaser on transfer. If your Card is lost or stolen, immediately call Kimpton at 1.800.762.4856. Your Card will be cancelled and a new Card will be mailed to you with any remaining Card balance as of the time it was cancelled. Lost or stolen Cards cannot be replaced without an original receipt at place of purchase or online.
COMPLIANCE WITH LAWS AND INDEMNITY
By purchasing or using the Cards, you are certifying and representing to Kimpton and Buyatab that your use of the Cards will comply with these Terms and Conditions and all applicable laws, rules and regulations, and that the Cards will not be used in any manner that is misleading, deceptive, fraudulent, unfair or otherwise harmful to consumers or Kimpton. In addition, you agree to defend and indemnify Kimpton and Buyatab and their subsidiaries and affiliates from and against any claims made against or expenses or liabilities incurred by any of them arising out of your use of the Cards in violation of any of these Terms and Conditions or in violation of any laws.
NO WARRANTY OF AVAILABILITY OR UNINTERRUPTED USE
From time to time the Card system may be inoperative, and when this happens, you may be unable to obtain information about the balance on your Card and Card transactions, or use your Card to pay for purchases. Please notify Kimpton if you have any problems using your Card. You agree that Kimpton, Buyatab and any other third party service providers and/or administrators shall not be responsible for any interruption of service.
JURY TRIAL AND CLASS ACTION WAIVER AND JURISDICTION
To the fullest extent permitted by law, you waive trial by jury with respect to any litigation arising out of or relating to these Terms and Conditions or your use of the Card. You further agree that any and all disputes or controversies between you and Kimpton and/or Buyatab shall be resolved on an individual basis without resort to any form of class action and shall not be consolidated with the claims of any other parties. Your waiver of the right to bring any dispute as a class action shall not be deemed unenforceable even if the governing state law would otherwise permit the action to be filed and prosecuted as a class action. These Terms and Conditions and any disputes arising out of or related to purchase or use of the Card will be governed by the laws of the State of California, any state or federal legal actions must be brought in San Francisco, California.
Except as otherwise provided by law, these Terms and Conditions apply to all Cards, whether purchased at hotel/restaurant locations, online, or received from third parties.
Some or all of the Card services may be performed by Kimpton, Buyatab, and such party's third-party service providers and Kimpton and Buyatab may provide any and all of your data and other information reasonably necessary for such service providers to provide the Card services and/or administer the Card program.
Kimpton may assign this agreement at any time without notice.
